- 1 With respect to the press release announced by the USDOJ regarding the return of US$1.5 million from the sale of two properties purchased by former President Chen et al, forfeited and sold under the civil forfeiture procedure, the Supreme Prosecutors Office replies and illustrates as follows
- 2 With regards to whether an appeal against the Lafayette military procurement fraud case will be filed, following a joint meeting with the Taiwan High Prosecutors Office and Taipei District Prosecutors Office, this Office has concluded that: no appeal will be filed against the part of the judgment against Lei Xue-Ming; an appeal will be filed against Guo Li-Heng, Guo Wen-Tian and Wang Chuan-Pu; the Office will continue prosecuting other persons who have received kickbacks.
- 3 Today, Mr. Chen Tsung-ming assumed the office of the Prosecutor General of the SPO, said he would select prosecutors of excellent conduct, outstanding performance, rich experience and high resistance to form the SIT within 2 months in order to effectively to fight severe corruption, election bribery, economic crimes (white collar crime) and cases endangering social order.
- 4 Today Supreme Prosecutors Office received a sum total of US$ 6,429,018, approximately equals to NTD 208,943,085, from Swiss authority, which is in nature illegal proceeds obtained by the former President Chen Shui-Bian in the corruption case with regard to the merging case of Yuanta with Fuhua during the Second Financial Reform Case and laundered to Switzerland. - 5 The resignation of Prosecutor General Chen Tsung-ming of this Office has been approved by Order of the President. In accordance with instructions issued by the Secretary of the Presidential Office in Letter Hua-Zhong-1-Li-Zi No. 0990019500, dated January 22, 2010, his remaining duties shall be assumed by Chief Prosecutor Tseng Yung-fu of the Supreme Prosecutors Office. The relevant transfer procedures were completed on January 26, 2010.
- 6 The press stated: “That Legislator (Congressman) Chiu Yi pointed out: …After Huang Jui-ching’s bank account in Switzerland was frozen, Former-President Chen once invited Former Minister of Justice Shih Mao-lin, Former Investigation Bureau Head Yeh Sheng-mao and Prosecutor-General of SPO Chen Tsung-ming to the Presidential Residence to study the subject issue…”. The press report is inconsistent with the facts.
- 7 The investigation conducted by the Special Investigation Division of Supreme Prosecutors Office upon the case referred to as Special Investigation No. 1 of 104 with regard to Wen-Chung Teng and Cheng-I Huang’s violation of the Insurance Act has been concluded and the indictment was filed on July 30th, 2015, with Taiwan Taipei District Court.(PDF)
- 8 The editorial of China Times today (14 July) opines that the rights of privacy and of reputation offered to government officials are different from ordinary people, therefore, it criticizes the private prosecution brought by Prosecutor-General of the Supreme Prosecutors Office (SPO) Chen Tsung-ming against Legislator Chiu Yi of the Legislative Yuan . The writer of the editorial more or less misunderstands the facts. The SPO wishes to explain:

- 30 The High Court’s judgment reasons in the case of bribery of Legislative Yuan members by the National Union Chinese Medicine Association had suggested that separate investigations should be initiated against 30 Legislative Yuan members in 1996, including Su Tseng-Chang, according to law. However, after reviewing all of the investigation and adjudication files in that case, this Division has determined that it is not necessary to assign prosecutors to further investigate those members.
